STATE OF ALABAMA CULLMAN COUNTY NOTICE OF MORTGAGE FORECLOSURE SALE WHEREAS, on the 4th day of March, 2013, Michelle Stacks, an unmarried worman, did execute and deliver to Phillip Lee Whisenant, as Executor of the Estate of Manual T. Whisenant, a mortgage on certain real estate hereinafter described, which mortgage appears of record in the Office of the Judge of Probate of Cullman County, Alabama, at Mortgage Book 1701, Page 10; and WHEREAS, default has been made in the performance of said mortgage as is provided therein, which default continues as this date, and said mortgage is subject to foreclosure. NOW THEREFORE, notice is hereby given that the undersigned, acting pursuant to the power contained in the aforesaid mortgage, will sell at public outcry to the highest bidder for cash at the front door of the Cullman County Courthouse in Cullman, Alabama, within the legal hours of sale on the 21st day of November, 2014, the real estate described in said mortgage, being more particularly described as: One hundred ten (110) feet off the North side of Lot 473 and Lot 501 of the City of Cullman, more particularly described as commencing at the northwest corner of Lot 473; thence southwardly along Third Avenue East 110 feet; thence at right angles eastwardly 264 feet to Fourth Avenue East; thence at right angles northwardly along Fourth Avenue East 110 feet; thence westwardly 264 feet to Third Avenue East and place of beginning. THIS PROPERTY WILL BE SOLD ON AN "AS IS, WHERE IS" BASIS, SUBJECT TO ANY EASEMENTS, ENCUMBRANCES AND EXCEPTIONS REFLECTED IN THE MORTGAGE AND THOSE CONTAINED IN THE RECORDS OF THE OFFICE OF THE JUDGE OF PROBATE WHERE THE ABOVE-DECRIBED PROPERTY IS SITUATED. THIS PROPERTY WILL BE SOLD WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT. SAID SALE will be made subject to the right of redemption of those entitled thereto under Alabama Law and for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure.
