SPECIAL MASTER COMMISSIONER’S SALE Thursday, November 20, 2014 CIVIL ACTION NO. 13-CI-00988 DIVISION II U.S. Bank National Association, PLAINTIFF VS. NOTICE OF SALE Pattie Kington, et. al., DEFENDANTS To comply with the orders of the Pulaski Circuit Court, the Special Master Commissioner John Gillum will sell the property described in the following action on Thursday, November 20, at the hour of 1:00 p.m., at or on the third floor of the Pulaski County Courthouse, Som-erset, Kentucky. Said property shall be sold to raise the amounts here-inafter set forth, together with interests and the costs of this action, and upon the following terms and conditions: (A) At the time of the sale the successful bidder shall either pay cash or make a deposit of ten percent (10%) of the purchase price, with the balance on credit for thirty (30) days. In the event the suc-cessful bidder desires or elects to credit the balance, he or she will be required to post bond and furnish an acceptable surety thereon. Said bond shall be for the unpaid purchase price and bear interest at the rate of twelve percent (12%) per annum from the date of sale until paid. (B) Risk of loss of improvements shall be on the purchaser from the date of sale. (C) The purchaser shall be required to assume and pay all taxes and assessments upon the property for the 2014 and all subsequent years. All taxes or assessments upon the property for prior years shall be paid from the sale proceeds. (D) The property shall otherwise be sold free and clear of any right, title, and interest of all the parties to the action and of their liens and encumbrances thereon, excepting easements and restric-tions of record in the Pulaski County Clerk’s Office, and such right of redemption as may exist in favor of the United States of America or the defendant(s). To raise the principal amount of $192,528.13, together with accrued interest thereon at the current Note rate of 2.85% per annum starting from March 1, 2013, until fully paid, plus any other charges which have ac-crued, plus Plaintiff’s costs expended, plus Plaintiff’s attorney fees of at least $2,500.00, as further described in the Order of Sale. Property Address: 611 Cliffside Drive Somerset, Kentucky 42503 Property description: A certain lot of ground located in the subdivision of the Burnside De-velopment Corp. and more particularly bounded and described as follows: Lot No. 33 of the Burnside Development Corporation (Cumberland Heights Subdivision) as shown by plat of same record in Plat Cabi-net A, Slide 129-1, Pulaski County Clerk’s Office, Kentucky, to which reference is made for a more complete description of said lot. Being the same property conveyed to Pattie Kington, by Deed of Con-veyance dated June 21, 2004, and being of record in Deed Book 0826, Page 412, in the Office of the Clerk of Pulaski County, Kentucky.
