___________________________________ LEGAL NOTICE ____________________________________ ORDINANCE NO. 14-17 BY Councilman Guy Sewell AN ORDINANCE LEVYING A ONE PER CENT (1%) TAX UPON THE GROSS PROCEEDS OR GROSS RECEIPTS DERIVED FROM ALL SALES TAXABLE UNDER THE OKLAHOMA SALES TAX CODE OR UNDER SECTIONS 66-31 THROUGH 66-56, INCLUSIVE, OF THE CODE OF ORDINANCES OF THE CITY OF ADA, OKLAHOMA; PROVIDING THAT THE REVENUES FROM SUCH TAX SHALL BE USED FOR CAPITAL IMPROVEMENTS TO WINTERSMITH POOL, GLENWOOD POOL, IRVING CENTER, WINTERSMITH AMPHITHEATER, MAIN STREET AND SPORTS COMPLEX; AND INSTITUTE A WORKFORCE HOUSING PROGRAM; PROVIDING SAID TAX SHALL BE IN ADDITION TO OTHER SALES TAXES LEVIED AND COLLECTED BY THE CITY; PROVIDING AN EFFECTIVE DATE; PROVIDING THE PROVISIONS ARE CUMULATIVE; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ADA, OKLAHOMA: SECTION 1. There is hereby levied a tax of one percent (1%) upon the gross proceeds or gross receipts derived from all sales taxable under the Oklahoma Sales Tax Code or under Sections 66-31 through 66-56, inclusive, of the Code of Ordinances of the City of Ada, Oklahoma, to be used for Capital improvements to Wintersmith Pool, Glenwood Pool, Irving Center, Wintersmith Amphitheater, Main Street and Sports Complex; and institue a Workforce Housing Program; including, but not limited to, construction of a new Wintersmith Pool; construction of a new Glenwood Pool; construction of a new senior citizens center at current Irving Center and remodeling of a portion of current Irving Center; construction of improvements to Wintersmith Amphitheater; construction of improvements to Main Street; construction of improvements to Sports Complex; institute a Workforce Housing Program; and other capital improvements as approved by the City Council; including payment of debt service on bonds or other obligations of the City or of the Ada Public Works Authority for such capital improvements. All revenues allocated to these purposes shall be deposited in a special account to be named the 2016 City Capital Improvements Sales Tax Account of the City of Ada to be audited on an annual basis, and such proceeds shall be used solely for the purposes designated herein. The tax authorized herein shall no longer be collected and shall expire on December 31, 2023. SECTION 2. The tax levied by this ordinance shall be and become effective immediately upon the expiration of the one percent (1%) sales tax provided in Ordinance Number 10-13, and for the purpose of compliance with the provisions of 68 O.S. § 2701(B) the sales tax provided by this ordinance shall be considered a continuation of the tax provided in Ordinance Number 10-13 with the proceeds of the sales tax to be used solely for the purposes provided herein, subject to approval of a majority of the qualified electors of the City of Ada, Oklahoma voting on a question for this purpose in the manner prescribed by law. SECTION 3. The provisions of this ordinance shall be cumulative, and in addition to any and all other taxing provisions of the City Ordinances. It is intended that the tax levied by this ordinance shall provide an additional one cent sales tax in addition to the two cent tax existing pursuant to Ordinance 66-37, and in addition to the existing 3/4% tax under Odinance 12-09 and the existing 1/4% tax under Ordinance 12-10. SECTION 4. The provisions of this ordinance are severable, and if any part of provision hereof shall be adjudged invalid or unenforceable by any court of competent jurisdiction, such adjudication shall not affect or impair the remaining parts of provisions hereof.
