SHEPARD-LOUCKS A/K/A CYNTHIA LOUCKS A/K/A CYNTHIA SHEPHERD-LOUCKS A/K/A CYNTHIA R. LOUCKS, if living, and if he be dead, his respective heirs-at-law, next of kin, distributees, executors, administrators, trustees, devisees, legatees, assignees, lienors, creditors and successors in interest, and generally all persons having or claiming under, by or through said who may be deceased, by purchase, inheritance, lien or otherwise, any right, title or interest in and to the premises; Defendants. Mortgaged Premises: 2331 Oswego Street Binghamton, (Town of Binghamton) NY 13903 TO THE ABOVE NAMED DEFENDANTS: YOU ARE HEREBY SUMMONED to answer the Complaint in the above entitled action and to serve a copy of your Answer on the plaintiff's attorney within twenty (20) days after the service of this Summons, exclusive of the day of service, or within thirty (30) days after completion of service where service is made in any other manner than by personal delivery within the State. The United States of America, if designated as a defendant in this action, may answer or appear within sixty (60) days of service hereof. In case of your failure to appear or answer, judgment will be taken against you by default for the relief demanded in the Complaint. NOTICE OF NATURE OF ACTION AND RELIEF SOUGHT THE OBJECT of the above captioned action is for the foreclosure of: Mortgage bearing the date of December 27, 2006, executed by Clark F. Crawford and Cynthia R. Shepard-Loucks to Mortgage Electronic Registration Systems, Inc. as nominee for Fremont Investment&Loan to secure the sum of $79,500.00, and interest, and recorded in the Office of the Clerk of Broome County on December 28, 2006 in Book: 3203 Page: 820. That Mortgage Electronic Registration Systems, Inc. as nominee for Fremont Investment&Loan duly assigned said Note and Mortgage to Nationstar Mortgage LLC by Assignment dated February 27, 2012 and recorded on March 7, 2012 in the Office of the Clerk of Broome County in Book 3537 Page 1290. The relief sought in the within action is a final judgment directing the sale of the premises described above to satisfy the debt secured by the Mortgage described above. Plaintiff designates Broome County as the place of trial. The basis of venue is the County in which the mortgaged premises is situated. Section: 160.20 Block: 2 Lot: 13 DATED: October 28, 2014 Rochester, New York NOTICE YOU ARE IN DANGER OF LOSING YOUR HOME If you do not respond to this summons and complaint by serving a copy of the answer on the attorney for the mortgage company who filed this foreclosure proceeding against you and filing the answer with the court, a default judgment may be entered and you can lose your home. Sending a payment to your mortgage company will not stop this foreclosure action. Schedule A ALL that tract or parcel of land situate in the Town of Binghamton, County of Broome andState of New York, described as follows: Lot No. fifty-two (52), as the same is laid downon a map of Sherwood Heights, Binghamton, Broome County, New York, made by Stacy S. Rumpeltin, C.E., and recorded in the Broome County Clerk's Office on November 6, 1916 in Book 3 of Maps, at page 54. Said Lot No. fifty-two (52) is situated on the west side of Oswego Street, and is fifty (50) feet wide, front and rear, and one hundred twenty (120) feet deep, according to said map.
