NOTICE OF INTENT TO REQUEST FOR RELEASE OF FUNDS November 26, 2014 Town of Marion 6021 Dale Drive Marion, MS 39342 601-483-9573 On or after December 11, 2014, the Town of Marion will request the Mississippi Development Authority to release funds under Title I of the Housing and Community Development Act of 1974, amended, for the following project: Project Title: Town of Marion Sewer System Improvements Purpose: The project consists of sewer improvements in the area of Old Country Club Drive and Lizelia Road. Lift Stations #1 and #2 will be replaced. Approximately 20 uncoated concrete manholes will be replaced with pre-cast bituminous coated manholes and 180 feet of epoxy manhole coating will be used to protect manholes that are still structurally sound but showing signs of deterioration. A road bore will be drilled underneath Lizelia Road to replace a sewer main as well as replacing several service lines and other miscellaneous repairs in the area. Location: Old Country Club Drive and Lizelia Road, Marion, MS Estimated Cost: $450,000.00 The activities proposed comprise a project for which a Finding of No Significant Impact on the environment was published on November 26, 2014. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Town of Marion Town Hall, 6021 Dale Drive, Marion, MS 39342 where the records is available for public examination and copying between the hours of: Monday - Friday, 8:00 a.m. -5:00 p.m. PUBLIC COMMENTS OF FINDINGS Any individual, group, or agency may submit written comment on the ERR to the Town of Marion, 6021 Dale Drive, Marion, MS 39342. All comments received by December 11, 2014 will be considered by the Town of Marion prior to submission of a request for release of funds. RELEASE OF FUNDS The Town of Marion certifies to the Mississippi Development Authority that Elvis Hudson in his capacity as Mayor of the Town of Marion consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Mississippi Development Authority¹s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Town of Marion to use HUD program funds. OBJECTION TO STATE RELEASE OF FUNDS The Mississippi Development Authority will accept objections to its release of funds and the Town of Marion¹s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Town of Marion; (b) the Town of Marion has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of release of funds by the Mississippi Development Authority; or (d) another Federal Agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58 Sec. 58.76) and shall be addressed to Attention: Shirley Thompson, Mississippi Development Authority, Community Services Division, Post Office Box 849, Jackson, MS 39205-0849.
