NOTICE OF FORECLOSURE Default having been made in the payment of the debt secured by that certain mortgage executed by Chris Yeager, a married man, and wife Amie Yeager on June 9, 2008, said mortgage being recorded on June 9, 2008 in the Office of the Judge of Probate of Cullman County, Alabama, in Mortgage Book 1567, Page 599. Said mortgage was modified pursuant to a Modification of Mortgage executed by Chris Yeager and Amie Yeager on March 2, 2009, said Modification of Mortgage being recorded on March 16, 2009 in the Office of the Judge of Probate of Cullman County, Alabama in Book 1591, Page 426. Traditions Bank as Mortgagee, by reason of such default, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, at the front door entrance of the Courthouse at Cullman, Cullman County, Alabama, on December 30, 2014 during the legal hours of sale, all of its right, title, and interest in and to the following described real estate, situated in Cullman County, Alabama, to-wit: A tract of land being in the SW 1⁄4 of the SW 1⁄4 of Section 17, Township 9 South, Range 1 West, Cullman County, Alabama, described as: commencing at the southwest corner of said SW 1⁄4 of the SW 1⁄4; thence North 2 degrees 02’ W 346 feet to the point of beginning; thence continue North 2 degrees 02’ West 736.17 feet; thence South 41 degrees 48’44” E 626.42 feet to the northerly right-of-way of County Road 1583; thence along said right-of-way South 39 degrees 22’37” West 341.86 feet; thence South 88 degrees 30’ West 174.79 feet to the point of beginning. Being 3.9 acres, more or less. THIS PROPERTY WILL BE SOLD ON AN “AS IS, WHERE IS” BASIS, SUBJECT TO ANY EASEMENTS, ENCUMBRANCES, AND EXCEPTIONS REFLECTED IN THE MORTGAGE AND THOSE CONTAINED IN THE RECORDS OF THE OFFICE OF THE JUDGE OF PROBATE OF THE COUNTY WHERE THE ABOVE-DESCRIBED PROPERTY IS SITUATED. THIS PROPERTY WILL BE SOLD WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF REDEMPTION OF ALL PARTIES ENTITLED THERETO. This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure.
