STATE OF MISSISSIPPI COUNTY OF LAUDERDALE RESOLUTION OF INTENT TO CREATE AND ANNEX AN AREA INTO THE NORTHEAST LAUDERDALE FIRE PROTECTION GRADING DISTRICT WHEREAS, on October 6, 2014, the Lauderdale County Board of Supervisors adopted a Resolution accepting the Petition of certain residents and landowners of Northeast Lauderdale to create and annex an area into the boundaries of the existing Northeast Lauderdale Fire Protection Grading District and to create a new district to be known as the Northeast Lauderdale Fire Protection Grading District; and WHEREAS, on October 20, 2014, the Lauderdale County Board of Supervisors adopted an Amended Resolution accepting the Petition of certain residents and landowners of Northeast Lauderdale to create and annex an area into the boundaries of the existing Northeast Lauderdale Fire Protection Grading District and to create a new district to be known as the Northeast Lauderdale Fire Protection Grading District. Said Amended Resolution changed only the date for the public hearing as set forth in the paragraph immediately below; and WHEREAS, the Board of Supervisors accepted such Petition and, pursuant to said Resolution, directed a public hearing be held on November 17, 2014 at 5:15 p.m. at the Lauderdale County Board Room located on the first floor of the Lauderdale County Courthouse Annex Building to receive comments and statements from the public as to the public convenience and necessity for the expansion and creation of said fire district, said date being not more than thirty (30) days after the filing of the Petition requesting the creation of said district; and WHEREAS, pursuant to said Resolution, the Clerk of the Board of Supervisors initiated publication of the hearing wherein notice of such hearing was to run in The Meridian Star, a newspaper published and having a general circulation within the proposed district, one (1) time per week for three (3) consecutive weeks, the first publication being not less than twenty-one (21) days prior to the hearing and the final publication being not more than fourteen (14) days prior to the date of such hearing. Said publications of Notice of said hearing were made on October 25, 2014, November 1, 2014 and November 8, 2014 and WHEREAS, on November 17, 2014, the Board of Supervisors, pursuant to said Notice, conducted a public hearing on the matter of the expansion and creation of the Northeast Lauderdale Fire Protection Grading District, hearing comments and testimony from all present who wished to present such comments and evidence; and WHEREAS, pursuant to the comments and evidence presented at the hearing to create and annex an area into the Northeast Lauderdale Fire Protection Grading District, the Board does find and declare that (1) public convenience and necessity requires the creation of the district, and (2) the creation of the district is economically sound and desirable; and WHEREAS, having made these findings based upon the testimony and evidence presented to the Board, we do hereby declare our intention to create and annex an area into the Northeast Lauderdale Fire Protection Grading District. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Lauderdale County, Mississippi, that we find and declare that (1) public convenience and necessity require the expansion and creation of the Northeast Lauderdale Fire Protection Grading District, and (2) that creation of the district is economically sound and desirable; BE IT FURTHER RESOLVED, that the Northeast Lauderdale Fire Protection Grading District shall have the boundaries and encompass the land area as follows: NORTHEAST LAUDERDALE FIRE PROTECTION GRADING DISTRICT A parcel of land lying and being situated in Townships 7 and 8 North, Ranges 16 and 17 East, Lauderdale County, Mississippi and being more particularly described as follows: Begin at the Southwest corner of the North 1Ž2 of the NW 1Ž4 of Section 20, Township 7 North, Range 16 East, Lauderdale County, Mississippi; Thence, North, 33,000¹ along the West lines of Sections 20, 17, 8, and 5 located in Township 7 North, Range 16 East and continuing along the West lines of Sections 32, 29, and 20 located in Township 8 North, Range 16 East to the Northwest corner of said Section 20; Thence, East, 15,840¹ along the North lines of Sections 20, 21, and 22 to the Northeast corner of said Section 22; Thence, South, 5,280¹ along the East line of Section 22 to the Southeast corner of said Section 22; BE IT FURTHER RESOLVED, that the Board of Supervisors intend to create said fire district as of January 20, 2015, and said district shall be called the Northeast Lauderdale Fire Protection Grading District. BE IT FURTHER RESOLVED, that a certified copy of this Resolution shall be published in a newspaper having a general circulation within said proposed district once a week for at least three (3) consecutive weeks prior to January 20, 2015. The first publication shall be made no later than twenty-one (21) days prior to the date specified and the last publication shall be made not more than fourteen (14) days prior to such date. Any qualified elector of such proposed district wishing to protest the creation of the district shall file a written petition with the Board of Supervisors on or before January 20, 2015. BE IT FURTHER RESOLVED, that the Board shall not assess the benefitted areas authorized in § 19-5-191 of the Mississippi Code of 1972, nor levy an additional tax thereon, as authorized by § 19-5-189 of the Mississippi Code of 1972.
