Case No. CJ-2014-1384W NOTICE BY PUBLICATION THE STATE OF OKLAHOMA TO: TD BANK, USA, N.A., as successor in interest to Target National Bank You, and each of you, are notified that you have been sued by HEARTLAND LAKES, LLC in the above cause in the District Court of Cleveland County, Oklahoma, and that said Plaintiff has filed a Petition in the office of the Clerk of said Court at Cleveland County, Oklahoma; and, unless you answer said Petition on or before the 30th day of February, 2015, said Petition will be taken as true and judgment rendered accordingly, to-wit: Judgment for the sum of $20,388.39 computed to September 24, 2012; plus interest accruing thereafter at the rate of 12.000% per annum, until paid, plus reasonable attorney fees and costs; and foreclosing Plaintiff’s real estate mortgage on the following real estate in Cleveland County, Oklahoma, to-wit: A tract of land being a part of the Southwest Quarter (SW/4) of Section One (1), Township 6 North (T6N), Range 1 West (R1W) West of the Indian Meridian, Cleveland County, Oklahoma, being more particularly described as follows: COMMENCING at the Southwest corner of said Southwest Quarter (SW/4) of Section 1; THENCE North 01 degrees 21 minutes 36 seconds East a distance of 2327.72 feet to a point; THENCE South 89 degrees 59 minutes 32 seconds East a distance of 2279.88 feet to the Point of Beginning; THENCE North 49 degrees 56 minutes 31 seconds East a distance of 466.08 feet to a point; THENCE South 01 degrees 17 minutes 09 seconds West a distance of 893.80 feet to a point; THENCE North 89 degrees 59 minutes 32 seconds West a distance of 336.75 feet to a point; THENCE North 00 degrees 00 minutes 28 seconds East a distance of 252.00 feet to a point; THENCE North 89 degrees 52 minutes 32 seconds West a distance of 100.00 feet to a point; THENCE North 00 degrees 00 minutes 28 seconds East a distance of 120.00 feet to a point; THENCE South 89 degrees 59 minutes 32 seconds East a distance of 100.00 feet to a point; THENCE North 00 degrees 00 minutes 28 seconds East a distance of 221.58 feet to the Point of Beginning; Containing 6.16 Acres More or less and Subject to All Easements and Rights of Way of Record. Also Known as Tract 6, South Lake adjudging said mortgage to be a first and prior lien on the subject premises; for sale of said real estate with appraisement; to provide to Plaintiff immediate possession of the collateral herein above mentioned; for application of the proceeds to satisfy said judgment, attorney’s fee and costs; barring your interest in said premises pursuant to a Statement of Judgment filed of record May 13, 2013, in Book M151 at Page 538 in the office of the County Clerk of Cleveland County; and for such other relief as may be proper.
