Date: Tuesday, February 24, 2015 Hearing Time: 5:00 p.m. CST Location: Cumberland Mountain State Park Room A, 24 Office Drive (Hwy 127 S) Crossville, Tennessee 38555 Division staff will hold a preliminary technical session with the public from 2:00-4:00 p.m. for discussion and review of the permit application and plans. The formal public hearing will begin at 5:00 p.m. Public comments will be received concerning the proposed reissuance/modification of an NPDES permit to the following applicant. Box 267 Harriman, TN 37748 Site Information Turner Surface Mine NPDES Permit TN0071633 SMCRA Permit 3189 Cumberland County This existing surface coal mine, preparation plant and associated areas located at latitude 35 59'34", longitude 84 59'34" consists of 584 acres and discharges into unnamed tributaries of Island Creek and Meadow Branch, Millstone Branch, Little Meadow Branch, and Rogers Creek. The modification is for the addition of Outfall 02A, and elimination of underground coal mining, preparation plant and associated areas (i.e. coal refuse storage area.) Office of Surface Mining (OSM) has approved the installation of an Anoxic Limestone Drain (ALD) beneath a GCL lined pond, Outfall 002. The surface mine is backfilled and reclaimed and Outfall 005 has been removed. Applicable to the NPDES Permitting Process The hearing is held in response to public interest and concerns about the existing site. The purpose of the hearing is to gather information from the public relevant to a final decision on the permit application. Comments not related to water quality or to the information contained in the permit application will not be considered in the NPDES decision-making process. Issues such as zoning, blasting, noise, dust, and traffic are not water-quality related and are not regulated by the Division or the NPDES program; therefore, consideration of these issues would not contribute relevant information. The hearing officer may limit oral presentations to five minutes and require all testimony be relevant to NPDES water quality-related issues. Undue repetition in oral presentations should be avoided so that all interested parties will have an opportunity to present their concerns. Written testimony related to the NPDES permit will be accepted at the hearing and by the Mining Section until March 6, 2015. Interested persons may obtain additional information and copy the application, draft permit, and supporting documentation from the NPDES permit file maintained at the Mining Sections office at the letterhead address. There is a nominal fee for copying.
