LEGAL NOTICE STATE OF ALABAMA CULLMAN COUNTY NOTICE OF MORTGAGE FORECLOSURE SALE WHEREAS, default having been made in the payment of the indebtedness secured by that certain Mortgage executed by Randy Dewayne Wren and Sandra Kay Wren, Husband and Wife to Vanderbilt Mortgage and Finance, Inc., on December 9, 2008, and in the principal amount of $68,628.03, said Mortgage being recorded in the land records of the Office of the Judge of Probate of Cullman County, Alabama on January 21, 2009 in Mortgage Book 1586 at Page 57; and WHEREAS, said default is continuing, the undersigned, Vanderbilt Mortgage and Finance, Inc., as current and present owner of said Mortgage, has elected to declare the entire indebtedness secured by said Mortgage due and payable as provided for therein; NOW THEREFORE, NOTICE is hereby given in accordance with the terms of said Mortgage and pursuant to law, that the undersigned, Vanderbilt Mortgage and Finance, Inc., will sell at public outcry to the highest bidder for cash, at the Main Entrance of the Cullman County Courthouse, located in Cullman, Alabama, on February 12, 2015 between the legal hours of 11:00 a.m. to 4:00 p.m., the following described real and personal property, lying and being in Cullman County, Alabama, to-wit: Commence at the Southwest Corner of the Northeast Quarter of the Southeast Quarter of Section 36, Township 8 South, Range 3 West; thence North 0 degrees 30 minutes 00 seconds East 708.29 feet to a point; thence South 87 degrees 09 minutes 47 seconds East 706.59 feet to an iron ½” capped rebar set on the East ROW of County Road No. 1435 and the point of beginning; thence North 39 degrees 24 minutes 21 seconds East, 295.91 feet along said ROW to an iron ½” capped rebar set in a ditch; thence South 24 degrees 43 minutes 08 seconds East 268.07 feet along an chord bearing and distance along said branch to an iron ½” capped rebar set on the North ROW of County Road No. 1447; thence North 87 degrees 09 minutes 47 seconds West 300.31 feet along said ROW back to the point of beginning. Said land lying in the NE1/4 of the SE1/4 of Section 36, Township 8 South, Range 3 West, Cullman County, Alabama. TOGETHER WITH AND INCLUDING all improvements constructed upon, affixed to, or located upon the above described real property, including without limitation, the residential dwelling located hereon more particularly described as a “Manufactured Home”, and which is hereby conclusively deemed to be real property, described as follows: Make: A 2009 Southern Homes Model #EC400 Serial Number SESAL4730. Together with the hereditaments and appurtenances thereto belonging, and also together with all buildings, structures, equipment, fixtures, and other improvements now existing, erected or installed thereon. Said sale will be made subject to any restrictions of record in the Probate Office aforesaid, matters of survey, and to any Federal or State tax liens, if any, and/or special assessments, if any, which might adversely affect the title to the premises. Said sale is to be made for the purpose of paying the above described Mortgage debt and all costs and expenses of foreclosure as provided for in said Mortgage and the proceeds of said sale will be applied as directed by and in said Mortgage.
