Case No. CJ-2014-8R THIRD ALIAS NOTICE OF SALE STATE OF OKLAHOMA TO: All persons having or asserting any interest, claim or lien in the following described real property and the Defendants, Ricky Dale Woodard and Midland Funding, LLC: Notice is given that on the 4th day of March, 2015, at 10:00 o'clock a.m., at the West door of the County Courthouse at Duncan, Oklahoma, the undersigned Sheriff will offer for sale and sell to the highest bidder all that certain real estate in Stephens County, Oklahoma, to-wit: SURFACE AND SURFACE RIGHTS ONLY: Lot 11, Block 8, Brown Addition to the City of Duncan, Stephens County, Oklahoma, which has a property address of: 903 W. Walnut, Duncan, Oklahoma Said lands and tenements have been appraised according to law at $45,000.00. Sale will be made pursuant to an Second Alias Order of Sale in Foreclosure issued upon judgment entered on the 1st day of August, 2014, in the District Court of Stephens County, Oklahoma, in Cause No. CJ-2014-8R, wherein BancFirst, was Plaintiff, and Ricky Dale Woodard and Midland Funding, LLC, were Defendants, to satisfy said judgment in the sum of $29,864.86, as of the 13th day of December, 2013, with interest thereon thereafter at the rate of $4.49 per diem, until paid, all as provided for in said Promissory Note, Mortgage and Modification of Mortgage, and for court costs in the amount of $238.70, private process server fees in the amount of $75.00, certified mailing expense in the amount of $7.37, publication expense in the amount of $168.62, a reasonable attorney fee in the amount of $3,000.00, for the sum of $433.23 for advances to pay unpaid ad valorem taxes on the subject real property, abstracting expense in the amount of $475.00, insurance, future advances for the maintenance and preservation of said real property, and all costs of this action accrued and accruing.
