CONSTRUCTION ADVERTISEMENT AND INVITATION FOR BIDS The Greater Texoma Utility Authority (GTUA) (Owner) on behalf of the Lake Kiowa Special Utility District will receive bids at the Lake Kiowa Special Utility District Office, 133 Kiowa Drive South, Lake Kiowa, Texas 76240, until 10:00 a.m. on March 3, 2015. The envelope must be sealed and clearly marked “2014 WATER SYSTEM IMPROVEMENTS: WATER MAIN REPLACEMENTS” (in the lower left hand corner). Bids will be publicly opened and read aloud at The Lake Kiowa Special Utility Office, 133 Kiowa Drive South, Lake Kiowa, Texas 76240 on March 3, 2015 at 10:00 a.m. for the following project: GTUA: LAKE KIOWA SPECIAL UTILITY DISTRICT WATER SYSTEM IMPROVEMENTS WATER MAIN REPLACEMENTS Instructions to Bidders, Proposal Forms, Specifications, Plans and Contract Documents, etc., may be examined without charge, at the office of the Greater Texoma Authority, Texas, 5100 Airport Drive, Denison, Texas 75020 or may be obtained at Cobb Fendley & Associates, 6801 Gaylord Parkway, Suite 302, Frisco, Texas 75034 for a fee of 100.00 non-refundable. Payment shall be made to Cobb Fendley & Associates. Plans can also be viewed and downloaded online at www.civcastusa.com at no charge. A bid bond in the amount of 5 percent of the bid issued by an acceptable surety shall be submitted with each bid. A certified check or bank draft payable to the Greater Texoma Utility Authority or negotiable U.S. Government Bonds (as par value) may be submitted in lieu of the Bid Bond. The successful Bidder must furnish performance and payment bonds each in the amount of 100 percent (100%) of the contract price from an approved Surety Company holding a permit from the State of Texas, to act as Surety. Attention is called to the fact that not less than, the federally determined prevailing (Davis-Bacon and Related Acts) wage rate, as issued by the Department of Commerce and contained in the contract documents, must be paid on this project. In addition, the successful bidder must ensure that employees and applicants for employment are not discriminated against because of race, color, religion, sex, age or national origin. Any contracts awarded under this Invitation for Bids is/are subject to the American Iron and Steel (AIS) requirements of P.L. 113-76 Consolidated Appropriations Act, 2014. This contract is subject to the Environmental Protection Agency’s (EPA) “fair share policy”, which includes EPA-approved “fair share goals” for Minority Business Enterprise (MBE) and Women Business Enterprise (WBE) firms in the Construction, Supplies, Equipment, and Services procurement categories. EPA’s policy requires that applicants and prime contractors make a good faith effort to award a fair share of contracts, subcontracts, and procurements, to Minority Business Enterprise and Women-Owned Business Enterprise firms. Although EPA’s policy does not mandate that the fair share goals be achieved, it does require applicants and prime contractors to demonstrate use of the six affirmative steps. The current fair share goals for the State of Texas are as follows: CATEGORY; MBE; WBE CONSTRUCTION; 12.94%; 8.72% SUPPLIES; 9.68%; 9.34% EQUIPMENT; 7.12%; 5.39% SERVICES; 10.84%; 5.72% The Greater Texoma Utility Authority reserves the right to reject any or all bids or to waive any informalities in the bidding. Bids may be held by GTUA for a period not to exceed 60 days from the date of the bid opening for the purpose of receiving bids and investigating the bidder’s qualifications prior to the contract award. 1. The contract will be contingent upon release of funds from the Water Development Board 2. Any contract or contracts awarded under this Invitation for Bids are expected to be funded in part by a loan from the Texas Water Development Board. Neither the State of Texas nor any of its departments, agencies, or employees are or will be a party to this Invitation for Bids or any resulting contract. 3.
