New York State Department of Environmental Conservation Notice of Complete Application Date: 01/27/2015 Applicant: BROOKS HOUSE OF BAR-B-Q 5560 ST HWY 7 ONEONTA, NY 13820 Facility: BROOKS HOUSE OF BAR-B-Q 5560 ST HWY 7 ONEONTA, NY 13820 Applicant ID: 4-3646-00251/00001 Permits(s) Applied for: 1-Article 17 Titles 7&8 Industrial SPDES- Groundwater Discharge Project is located: in ONEONTA in OTSEGO COUNTY Project Description: The applicant proposes to modify an existing discharge of 8,500 gallons per day (gpd)to a 15,000 day gpd discharge of treated sanitary and process wastewater to ground water from a Membrane Biological Reactor treatment plant at the applicant's facility located at 5560 State Highway 7, in the Town of Oneonta, Otsego County. The applicant plans to construct a new system to replace the existing two septic systems. The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statue is considered to satisfy regulatory standards for permit issuance, based on the information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought of for the overall proposed project. Availability of Applicant Documents: Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person. State Environmental Quality Review (SEQR) Determination Project is an Unlisted Action and will not have significant impact on the environment. A Negative Declaration is on file. A coordinate review was performed. SEQR Lead Agency Otsego Town Planning Board State Historic Preservation Act (SHPA) Determination A Cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological structures. No further review in accordance with SHPA is required.
