Bates (the “Petitioner”), produced and filed in the District Court of Pontotoc County, State of Oklahoma, an instrument in writing purporting to be the Last Will and Testament of the Decedent (the “Will”) and also filed a Petition for Probate of Will (the “Petition”) praying that the Will be admitted to probate, that Letters Testamentary be issued to the Petitioner as Personal Representative to serve without bond, and the identity of all heirs, devisees, and legatees of the Decedent be judicially determined.
