SHERIFF SALE Wednesday, April 1, 2015 AT 1:30 P.M., EST In The Office of the Union County Sheriff REAL ESTATE By virtue of a Writ of Execution issued out of the Court of Common Pleas of Union County, Pennsylvania, to Execution Docket No: 14-624: Wells Fargo Bank, National Association, As Trustee for Soundview Home Loan Trust 2007-Opt1, Asset-Backed Certificates, Series 2007-Opt1 v. Andrew R. Rockey and Jennifer M. Rockey. ALL THAT CERTAIN lot of ground in the Westlawn Residential Subdivision in East Buffalo Township, Union County, Pennsylvania, being Lot No. 47 in the revised plan of said subdivision as recorded in Union County Plot Book 1, Page 7, bounded and described as follows: BEGINNING at the intersection of the northern right-of-way line of Jean Boulevard and the eastern right-of-way line of Township Highway No. T460; THENCE along said Township Highway, North 12^ 39' 30" East, a distance of 181.59 feet to Lot No. 48; THENCE along Lot No. 48, South 84^ 56' East, a distance of 99.55 feet to Lot No. 46; THENCE along Lot No. 46, South 05^ 04' West, a distance of 180 feet to the northern right-of-way line of Jean Boulevard; THENCE along the northern right-of-way line of Jean Boulevard, North 84^ 56' West, (incorrectly stated as East on prior deeds), a distance of 123.51 feet to the place of Beginning. BEING the same premises that Maurice R. Brubaker and Deborah L. Brubaker, husband and wife, and Robert M. Brubaker and Sherry L. Brubaker, husband and wife, by their deed dated March 26, 2007 and recorded to Union County Record Book 1663, Page 238, granted and conveyed unto Jennifer M. Rockey and Andrew R. Rockey, wife and husband. SUBJECT, HOWEVER, to the following covenants and restrictions which shall form a part of the consideration and be taken to be real covenants running with the land and binding upon the Parties of the Second Part, their heirs, executors, administrators and assigns: 1. The land herein granted shall be used for residential purposes only, and no dwelling shall be erected on the land herein granted which shall cost less than Twelve Thousand Dollars ($12,000.00) if a single dwelling, or less than Eighteen Thousand Dollars ($18,000.00) if a double dwelling, and that said dwellings are to be erected within the limits of the building lines as shown by the Schedule of Set Backs of Westlawn Residential Subdivision, as recorded in Union County Deed Book 80, Page 180, the schedule for Lot No. 47, being 35' from Jean Boulevard and 30' from Township Highway No. T460, side yard at least 8' with total side yards of 20'. 2. In the event a purchaser acquired two or more adjacent lots, or parts of lots, then a building may be placed on or across the inside lot line; in no case, however, shall the building be placed closer to any street or property owned by another than the area designated by the Schedule of Set Backs. 3. In the construction of any new dwelling or other building appurtenant thereto, it shall be necessary to secure the services or approval of a registered architect. a. All buildings, fences, and other structures erected or placed upon said site shall be of an attractive design, and before any work upon any such building, fence or structure is commenced, the design thereof shall be submitted to an approved in writing by William D, Brown, The grantee shall also before any work is commenced on any building or structure on said site, deposit with William D. Brown a set of blueprints showing the design and plans thereof, and a copy of the specification thereof, as approved by William D. Brown, is to be retained by William D. Brown until such building or structure has been completed according therewith. b. Upon the death of William D. Brown, the approval described in this covenant shall not be required unless, within ninety (90) days of the date of death of the said William D. Brown or earlier if desired by the majority of the regular owners of a majority of the lots in this subdivision and duly recorded appointing a representative or representatives, who shall thereafter exercise the same powers previously exercised by the said William D. Brown. 4. The said Grantees, their heirs, or assigns, shall, or will not manufacture or sell or cause or permit to be manufactured or sold on any portion of the premises hereby conveyed, any goods or merchandise of any kind, except where expressly permitted, and will not carry on or permit, any matter or thing which shall be a nuisance, unwholesome or offensive to the neighborhood, and that no public garage shall be erected on this premises. 5. No rubbish, ashes or debris of any kind shall be dumped at the rear of any said lot. 6. All sidewalks and curbs, when erected, are to be constructed in accordance with lines and grades, to be given by a registered engineer; all sidewalks to be four (4) feet in width the inside line of sidewalks to be set on the property line; and outside face of curbs to be set ten (10) feet from the property line. BEING PREMISES 288 Jean Blvd, Lewisburg, PA TAX PARCEL NO.: 002-033-045.00000 CONDITIONS OF SALE The real property will be sold subject to the following conditions of sale; ten percent (10%) of the higher sum bid struck off shall be deposited in each case with the Sheriff by the highest bidder when his bid is registered, provided that in no case shall less than One Hundred Dollars ($100.00) be deposited and that in each case the deposit shall be sufficient to cover the Sheriff's costs; otherwise upon failure or refusal to make such deposit, the bidder shall lose all benefits of his bid and the property may be immediately put up again and sold unless a deposit of the required bid made by a second bidder willing to take the property at the highest bid price. The balance shall be paid on or before April 21, 2015. The sale is also subject to Pennsylvania Transfer Tax, plus County Poundage. Notice is hereby given all claimants and parties in interest that the Sheriff will for all sales where filing of schedule of distribution is required, file the said schedule of distribution not later than thirty (30) days after the sale, in his office, where the same will be available for inspection and that distribution will be made in accordance with the schedule, unless exceptions are filed thereto within twenty (20) days thereafter.
