Gill, Jr. (hereinafter called "Petitioner") produced and filed in the District Court of the County of Stephens and State of Oklahoma an instrument in writing purporting to be the Last Will and Testament of the Decedent and also filed a Petition praying that the Last Will and Testament be admitted to probate, that Letters Testamentary be issued to Petitioner, and that the identity of all heirs, devisees and legatees of the Decedent be determined for purposes of filing waivers or consents as permitted by law.
