Case No. PB-2013-60 COMBINED NOTICE TO CREDITORS AND NOTICE OF HEARING TO: All persons interested in the Estate of David Wendel Hodges, Deceased You are hereby notified that on the 6th day of August, 2013, Diana L. Bolin (the “Petitioner”), by and through Susie Bolin Summers of Mayhue, Summers & Johnson, PLLC, Attorneys for Petitioner, filed in the District Court of Pontotoc County a Petition for Summary Administration, Appointment of Special Administrator, and Determination of Heirs (the “Petition”). The Petitioner has alleged that David Wendel Hodges, deceased (the “Decedent”), died intestate on June 28, 2013, domiciled in and residing in Pontotoc County, State of Oklahoma, and that the total value of the Decedent’s property in Oklahoma is $13,000.00. A diligent search and inquiry has been made to ascertain if the Decedent left any Last Will and Testament, but none has been found. Petitioner has asked this Court to dispense with the regular estate proceedings and to proceed with other summary proceedings pursuant to Section 245 et seq. of Title 58 of the Oklahoma Statutes. In an Order for Combined Notice entered on the 6th day of August, 2013, the Court found that it should dispense with the regular estate proceedings prescribed by law and order notice to creditors and issue an order for hearing upon the Petition for Summary Administration and Determination of Heirs, the Final Accounting, and Petition for Determination of Heirs, Devisees and Legatees and Distribution. Pursuant to the Order for Combined Notice, all creditors having claims against David Wendel Hodges, deceased, are required to present the same with a description of all security interests and other collateral (if any) held by each creditor with respect to such claim, to Diana L. Bolin, Special Administrator, at the law offices of Susie Bolin Summers, Mayhue, Summers & Johnson, PLLC, Attorneys for the Personal Representative, Post Office Box 1488, Ada, Oklahoma 74821-1488, on or before the following presentment date: September 5, 2013, or the same will be forever barred. Notice is also hereby given that a hearing will be held on the 2nd day of October, 2013, at 10:00 o’clock A.M. at the Pontotoc County Courthouse, Ada, Oklahoma. At the hearing the Court will decide whether to approve the Petition for Summary Administration and Determination of Heirs, and the Final Account and Petition for Determination of Heirs, Devisees and Legatees, and Distribution of the Petitioner. The Final Account and Petition for Determination of Heirs, Devisees and Legatees and Distribution will be filed herein on or before the 10th day of September, 2013. You are hereby advised that you must file objections to the Petition for Summary Administration and Determination of Heirs and the Final Account and Petition for Determination of Heirs, Devisees and Legatees, and Distribution at least ten (10) days before the hearing and send a copy to the Petitioner in care of her attorney, Susie Bolin Summers, Mayhue, Summers & Johnson, PLLC, Post Office Box 1488, Ada, Oklahoma 74821-1488, or you will be deemed to have waived any objections. If you have no objections, you need not appear at the hearing or make any filings with the Court.
