________________________________________________________________________ LEGAL NOTICE ________________________________________________________________________ ORDINANCE NO. 13-04 BY: Councilman Gary Sewell AN ORDINANCE EXTENDING THE CORPORATE LIMITS OF THE CITY OF ADA, OKLAHOMA, ANNEXING AN AREA ADJACENT TO THE CITY OF ADA INTO AND AS A PART OF THE CORPORATE LIMITS OF SAID CITY OF ADA, AS SAID ANNEXATION IS MORE PARTICULARLY DESCRIBED IN THE ORDINANCE; PROVIDING FOR ZONING OF THE ANNEXED AREA; PROVIDING FOR SEVERABILITY. WHEREAS, a petition has been presented to the City Council of the City of Ada, Oklahoma, proposing consideration, approval, and passage of an ordinance extending and annexing into the corporate limits of the City of Ada certain real property adjacent to the City under the Charter and Ordinances of the City of Ada, and the laws of the State of Oklahoma, and said Council after hearing the facts and being sufficiently advised, finds as follows: 1. That all requirements necessary for the annexation of said property to the City of Ada and to extend the corporate limits thereof have been complied with as provided by the Charter and Ordinances of the City of Ada, and the laws of the State of Oklahoma as set out in Title 11, Oklahoma Statutes, Section 21-101, et seq.; 2. That pursuant to 11 O.S. §21-105 at least three-fourths of the registered voters and the onwers of at least three-fourths (in value) of the said property have petitioned for annexation of said property; 3. That notice of the proposed annexation has been published as required by law for at least once each week for two successive weeks in a newspaper of general circulation in the City of Ada, Oklahoma; 4. That a public hearing was held on the date and time, and at the place, specified in the aforesaid notice, prior to consideration of this ordinance. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ADA, OKLAHOMA: Section 1. Annexed Territory. That said area, situated in Pontotoc County, Oklahoma, shall become attached to and be within the corporate limits of the City of Ada, Oklahoma, and shall hereafter be considered an integral part of the corporate limits, and said corporate limits to the City of Ada, Oklahoma, are extended and enlarged so as to include all of the property described as follows, to-wit: Tract 1, NW/4 SECTION 32 A tract of land located in the NW/4 of Section 32, Township 4 North, Range 6 East, Pontotoc County, Oklahoma, more particularly described as follows: Beginning at the Southeast corner of the NW/4 of said Section 32; thence S 89º24’35” W along the South line of said NW/4 a distance of 803.50 feet; thence N 29º14’56” E a distance of 76.96 feet; thence N 67º36’08” W a distance of 151.56 feet; thence N 24º23’53” E a distance of 16.98 feet; thence N 65º36’07” W a distance of 981.50 feet; thence N 26º48’32” E a distance of 133.16 feet; thence S 65º22’13” E a distance of 971.93 feet; thence S 69º22’36” E a distance of 168.71 feet; thence N 29º14’56” E a distance of 57.85 feet; thence S 79º31’17” E a distance of 672.86 feet to a point on the east line of said NW/4; thence S 00º41’53” E a distance of 120.00 to the point of beginning; containing 6.69 acres more or less. Tract 2, NE/4 SECTION 32 A tract of land located in the NE/4 of Section 32, Township 4 North, Range 6 East, Pontotoc County, Oklahoma, more particularly described as follows: Commencing at the Southwest corner of the NE/4 of said Section 32; thence N 00º41’53” W along the West line of said NE/4 a distance of 31.70 feet to the point of beginning; thence continuing N 00º41’53” W a distance of 88.30 feet; thence S 79º31’17” E a distance of 20.83 feet to a point on the East right of way line of Asa Road; thence S 12º55’58” W along said right of way line a distance of 86.70 feet to the point of beginning, containing 0.020 acres more or less. Tract 3, SE/4 SECTION 32 A tract of land located in the SE/4 of Section 32, Township 4 North, Range 6 East, Pontotoc County, Oklahoma, more particularly described as follows: Commencing at the Northwest corner of the SE/4 of said Section 32; thence S 00º41’59” E along the West line of said SE/4 a distance of 70.00 feet to the point of beginning; thence N 88º46’18” E a distance of 552.35 feet to the East right of way line of Western Avenue; thence S 00º52’45” E along the East right of way line of Western Avenue a distance of 1143.07 feet to a point on the South right of way line of 14th Street; thence S 89º05’01” W along the South right of way line of 14th Street a distance of 55.91 feet to a point on the West line of said SE/4; thence N 00º41’59 W along the West line of said SE/4 a distance of 60.00 feet to the North right of way line of 14th Street; thence N 89º05’01” E along the North right of way line of 14th Street a distance of 495.75 feet to the West right of way line of Western Avenue; thence N 00º52’45” W along the West right of way line of Western Avenue a distance of 1067.26 feet to the South right of way line of State Highway; thence S 72º08’01” W along the right of way of State Highway a distance of 208.89 feet; thence S 61º02’27” W along the right of way line of State Highway a distance of 332.45 feet to a point of the West line of said SE/4; thence N 00º41’59” W a distance of 230.00 feet to the point of beginning; containing 3.49 acres more or less. Tract 4, SW/4 SECTION 32 A tract of land located in the SW/4 of Section 32, Township 4 North, Range 6 East, Pontotoc County, Oklahoma, more particularly described as follows: Beginning at the Northeast corner of said SW/4; thence S 00º41’59” E along the East line of said SW/4 a distance of 299.76 feet to a point on the right of way line of Latta Road; thence S 73º36’37” W along right of way line a distance of 100.06 feet; thence S 49º46’57” W along right of way line a distance of 192.66 feet; thence S 38º41’20” W along right of way line a distance of 289.90 feet; thence in a Southwesterly direction along a curve to the left having a radius of 1010.00 feet, a chord bearing of S 34º10’06”W, an arc distance of 159.38 feet; thence S 04º55’06” W along right of way line a distance of 349.75 feet to a point on the North right of way line of 14th Street; thence N 89º05’01”W along the North right of way line of 14th Street a distance of 554.18 feet to a point on the East line of said SW/4; thence S 00º41’59”E a distance of 60.00 feet to the South right of way line of 14th Street; thence S 89º05’01” W along the South right of way line of 14th street a distance of 772.67 feet to a2 point on the West right of way line of Latta Road; thence N 14º57’18” E along right of way a distance of 187.41 feet; thence N 77º05’02” W along right of way a distance of 10.00 feet; thence N 14º57’18” E along right of way a distance of 18.70 feet; thence in a Northeasterly direction along a curve to the right having a radius of 1120.00 feet; a chord bearing of N 26º49’19” E, an arc distance of 463.94 feet; thence N 38º41’20” E along right of way a distance of 382.95 feet; thence in a Northeasterly direction along a curve to the left having a radius of 655.00 feet, a chord bearing of N 34º13’19”E, an arc distance of 102.13 feet; thence N 71º09’19” W along right of way a distance of 478.42 feet; thence N 65º38’19” W along right of way a distance of 154.70 feet to a point on the North line of said SW/4; thence N 89º24’35”E a distance of 803.50 feet to the point of beginning; containing 7.272 acres more or less. Section 2. Zoning Classification. The annexed tracts are public right-of-ways, therefore no zoning is required. Section 3. Severability If any one or more of the sections, sentences, clauses or parts of this ordinance, chapter or section shall for any reason be held invalid, the invalidity of such section, clause or part shall not affect or prejudice in any way the applicability and validity of any other provision of this ordinance. It is hereby declared to be the intention of the City Council of the City of Ada that this ordinance would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included herein.
