Case No. CJ-2014-37 NOTICE OF SALE OF LAND UNDER EXECUTION NOTICE IS HEREBY GIVEN that in pursuance of a Writ of Special Execution and Order of Sale in Foreclosure issued out of the District Court of Pontotoc County, Oklahoma on April 2, 2014, in an action wherein Vision Bank, N.A. is Plaintiff and James Louis McKee, Jr. and Summer Dawn McKee are Defendants, directed to me, the undersigned Sheriff of Pontotoc County, Oklahoma, commanding me to levy upon and sell with appraisement the following-described real property located in Pontotoc County, Oklahoma: A tract of land in the SW/4 of NW/4 of Section 2, Township 3 North, Range 4 East, more particularly described as follows: commencing at the southwest corner of the SW/4 of NW/4 of said Section 2; thence N 00 deg. 00’ 00” W along the west line of said SW/4 of NW/4, a distance of 466.74 feet to the point of beginning; thence continuing N 00 deg. 00’ 00” W along the west line of said SW/4 of NW/4 a distance of 618.12 feet; thence S 90 deg. 00’ 00” E a distance of 397.96 feet; thence S 00 deg. 00’ 00” E a distance of 423.60 feet; thence N 90 deg. 00’ 00” W a distance of 145.00 feet; thence S 00 deg. 00’ 00” E a distance of 194.52 feet; thence N 90 deg. 00’ 00” W a distance of 252.96 feet to the point of beginning, containing 5.0 acres, more or less (the “Property”); Property Address: 15376 County Road 3450, Ada, OK 74820 to satisfy a judgment and decree of mortgage foreclosure in favor of said Plaintiff and against James Louis McKee, Jr., and Summer Dawn McKee, obtained and made in said Court on April 2, 2014, on Plaintiff’s cause of action wherein the Court found there was due to Plaintiff the total principal sum of $89,634.87 inclusive of interest and late fees through March 31, 2014, plus interest accruing thereafter at the contractual rate specifically set forth in the Journal Entry of Judgment (5.500%) per annum on the unpaid balance; together with an attorney’s fee and costs incurred through date of judgment in the amount of $4,000.00; and for all costs accrued and accruing until paid, including property preservation costs to be advanced by Plaintiff; I will on the 11th day of June, 2014, at the hour of 10:00 o’clock a.m. of said day at the Courthouse in Ada, Pontotoc County, Oklahoma, offer for sale and sell to the highest bidder for cash the said property above described, or as much thereof as will satisfy said judgment with interest, costs, and attorney’s fees, said sale to be subject to taxes on said property, if any; the total appraised value of the real property being the sum of $115,000.00.
