Moore, if living, and if deceased, her Unknown Successors; and, Joe Bagwell, Defendants. Case No. CJ–2014-102 NOTICE OF SALE OF LAND UNDER EXECUTION TO: Margaret E. Moore, if living, and if deceased, her Unknown Successors, Joe Bagwell, and all other persons claiming any right, title or interest in and to the real property described below NOTICE IS HEREBY GIVEN that in pursuance of a Writ of Special Execution and Order of Sale in Foreclosure issued out of the District Court of Pontotoc County, Oklahoma on August 15th, 2014, in an action wherein Vision Bank, N.A. is Plaintiff and Margaret E. Moore and Joe Bagwell are Defendants, directed to me, the undersigned Sheriff of Pontotoc County, Oklahoma, commanding me to levy upon and sell with appraisement the following-described real property located in Pontotoc County, Oklahoma: Part of the Northeast Quarter of the Northeast Quarter (NE/4 NE/4) of Section 27, Township 5 North, Range 4 East, Pontotoc County, Oklahoma, more particularly described as follows: TRACT 9: Commencing at the Northeast corner of said Section 27; thence S 00°01’E a distance of 495.0 feet to the point of beginning; thence N 89°45’ W a distance of 660.0 feet; thence S 00°01’ E a distance of 165.0 feet; thence S 89°45’ E a distance of 660.0 feet; thence N 00°01’ W a distance of 165.0 feet to the point of beginning, containing 2.5 acres, more or less; AND TRACT 10: Commencing at the Northeast corner of said Section 27; thence S 00°01’ E a distance of 660.0 feet to the point of beginning; thence N 89°45’ W a distance of 660.0 feet; thence S 00°01’ E a distance of 165.0 feet; thence S 89°45’ E a distance of 660.0 feet; thence N 00°01’ W a distance of 165.0 feet to the point of beginning, containing 2.5 acres, more or less. Property Address: 7123 County Road 3450, Ada, OK 74820 to satisfy a judgment and decree of mortgage foreclosure in favor of said Plaintiff and against Margaret E. Moore, obtained and made in said Court on August 14th, 2014, on Plaintiff’s cause of action wherein the Court found there was due to Plaintiff the total principal sum of $111,964.92 inclusive of interest and late fees through August 14, 2014, plus interest accruing thereafter at the contractual rate specifically set forth in the Journal Entry of Judgment (6.000% per annum) on the unpaid balance; together with an attorney’s fee of $5,000.00 and costs incurred through date of judgment in the amount of $2,997.68; and for all costs accrued and accruing until paid, including property preservation costs to be advanced by Plaintiff; I will on the 15th day of October, 2014, at the hour of 10:00 o’clock a.m. of said day at the Courthouse in Ada, Pontotoc County, Oklahoma, offer for sale and sell to the highest bidder for cash the said property above described, or as much thereof as will satisfy said judgment with interest, costs, and attorney’s fees, said sale to be subject to taxes on said property, if any; the total appraised value of the real property being the sum of $115,000.00.
