CJ-2014-99E (Published in the Thursday editions of The Duncan Banner, October 30 adn November 6, 2014-2 times) IN THE DISTRICT COURT WITHIN AND FOR STEPHENS COUNTY STATE OF OKLAHOMA INTERNATIONAL BANK OF COMMERCE, Plaintiff, vs, RANDALL PELTON and ANN MARIE PELTON, husband and wife, ONEOK HYDROCARBON, L.P., a Delaware Limited Partnership; ARVEST BANK; MIDLAND FUNDING, LLC; FAUST CORPORATION and the OCCUPANTS OF THE PREMISES, Defendants, Case No. CJ-2014-99E NOTICE OF SHERIFF'S SALE THE STATE OF OKLAHOMA TO: All interested bidders and all persons having or asserting any interest, claim or lien in the following described real property whose interest in the real property is sought to be extinguished and the above-named Defendants NOTICE is hereby given that on the 3 day of December, 2014, at the hour of 10 o'clock a.m.,at the West front door of the County Courthouse at Duncan, Stephens County, Oklahoma, the undersigned Sheriff of said County will offer for sale and sell for cash, at public auction, to the highest bidder, with appraisement, all that certain property situated in Stephens County, Oklahoma, to-wit: The Surface and Surface Rights Only in and to the SE 1/4 of the SE 1/4 of the NW 1/4 and the N 1/2 of the NE 1/4 of the NE 1/4 of the SW1/4 of Section 26, Township 2 North, Range 6 West, I.M., Stephens County, Oklahoma, or so much thereof as will satisfy the judgment, interest, attorney's fees and costs as hereinafter set out. The above-described real property shall be sold to satisfy the judgment of the Plaintiff, International Bank of Commerce, against the Defendants, Randall Pelton and Ann Marie Pelton, husband and wife, jointly and severally, as follows: The principal sum of $24,797.47, together with accrued interest in the amount of $442.56 as of the 8th day of May, 2014, and thereinafter at the rate of 6.125% per annum or $4.381761233, per day, until paid, late fees of $296.26, title report expense of $125.00, abstracting expense of $700.00, advancements for ad valorem taxes, if any, attorney's fees of $3,250.00 and all costs of this action accrued and accruing; and, You are further notified that said sale will be made pursuant to a Special Execution and Order of Sale issued upon a judgment and decree of foreclosure filed in the District Court of Stephens County, Oklahoma, on the 17th day of October, 2014, in which International Bank of Commerce is the Plaintiff, and Randall Pelton, et al, are Defendants, to satisfy said judgment and decree of foreclosure in favor of the Plaintiff and against the Defendants, above- named. You are further notified that the undersigned Sheriff has had the above-described real property and tenements duly appraised, according to law, and the order of this Court, and the same has been appraised in the amount of $15,000, You are further notified that said property will be sold subject to unpaid ad valorem taxes if any.
