STATE OF ALABAMA COUNTY OF LIMESTONE NOTICE is hereby given that a bill substantially as follows will be introduced in the 2015 Regular Session of the Legislature of Alabama and application for its passage and enactment will be made: A BILL TO BE ENTITLED AN ACT To authorize the governing body of the City of Athens, Alabama, acting pursuant to Section 217 of the Constitution of Alabama of 1901, as amended, to increase the rate at which there may be levied and collected by the City of Athens, on all taxable property situated within such City the special ad valorem tax for special purpose or purposes which is authorized in Amendment 8 to the Constitution of Alabama of 1901 (codified as Section 216.01 of the Official Recompilation of the Constitution of Alabama of 1901) by vote of a majority of the electors voting in an election to approve such levy, to a maximum rate, for any tax year of the City, which is equal to $1.20 on each one hundred dollars (12 mills on each dollar) of assessed value. BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. The following words and phrases used in this Resolution, and others evidently intended as the equivalent thereof, in the absence of a clear implication herein otherwise, shall be given the following respective meanings herein: “Amendment No. 8” means that certain amendment to the Constitution that was proposed by Act No. 650, Page 899, enacted at the 1919 Session of the Legislature of Alabama, codified as Section 216.01 of the Official Recompilation of the Constitution of Alabama of 1901. “City” means the City of Athens, Alabama. “Constitution” means the Constitution of Alabama of 1901. “Section 217” means Section 217 of the Constitution, as amended by that certain amendment to the Constitution that was proposed by Act No. 116 enacted at the 1971 Third Special Session of the Legislature of Alabama, and by that certain amendment to the Constitution that was proposed by Act No. 6 enacted at the 1978 Second Special Session of the Legislature of Alabama, codified as Section 217 of the Official Recompilation of the Constitution of Alabama of 1901. “Special Purpose Tax” means the special ad valorem tax authorized pursuant to Amendment 8 to be levied within the City for special purpose or purposes upon vote of the majority of the qualified electors of the City voting at an election called for that purpose. Section 2. Pursuant to Amendment 8, upon a vote of a majority of the qualified electors of the City voting at an election called for that purpose, the City is presently authorized to levy and collect the Special Purpose Tax at a rate of $0.50 on each one hundred dollars (5 mills on each dollar) of assessed value for any special purpose or purposes. Pursuant to a resolution adopted by the City Council of the City in accordance with the provisions of Section 217, the City proposes to increase the rate at which the City is authorized to levy and collect the Special Purpose Tax to a maximum rate, for any year of the City, to a rate equal to $1.20 on each one hundred dollars (12 mills on each dollar) of assessed value. Section 3. Pursuant to subsection (f) of Section 217 and a resolution heretofore adopted by the City Council of the City after a public hearing, the City is authorized to levy and collect the Special Purpose Tax at a maximum rate, for any tax year, which is equal to $1.20 on each one hundred dollars (12 mills on each dollar) of assessed value. Section 4. The increase in the rate at which the Special Purpose Tax is authorized to be levied and collected pursuant to this Resolution is subject to approval of a majority of the qualified electors residing in the City who vote on the proposed increase at a special election called and held for such purpose pursuant to the provisions of subsection (f) of Section 217. Section 5. This Act shall become effective when it is signed by the Governor or upon its otherwise becoming law. The News Courier February 6, 13, 20 and 27, 2015
