CJ-2015-27 NOTICE OF SHERIFF¹S SALE Notice is hereby given that in pursuance of a Special Execution and Order of Sale with Appraisement issued out of the District Court of Pittsburg County, Oklahoma on April 2nd, 2015, in an action wherein BancFirst, an Oklahoma Banking Corporation, (²BancFirst McAlester:) was Plaintiff and Linda L. Pope and James C. Pope, Donna Scrivner, Pittsburg County Treasurer, Pittsburg County, Oklahoma, Board of County Commissioners, Pittsburg County, Oklahoma, and the State of Oklahoma, ex rel. Oklahoma Health Care Authority, John Doe and Jane Doe were Defendants, commanded me to levy upon and sell with appraisement the following described property in Pittsburg County, Oklahoma, to-wit: ALL THAT PART OF THE SE 1/4 SW 1/4 NE 1/4 OF SECTION 13, TOWNSHIP 4 NORTH, RANGE 16 EAST OF THE INDIAN BASE AND MERIDIAN, LYING NORTH OF THE CENTERLINE OF SAVAGE HIGHWAY, IN PITTSBURG COUNTY, STATE OF OKLAHOMA The Real Property, or its address is commonly known as: HCR 73 Box 51, Hartshorne, Oklahoma 74547. To satisfy a judgment and decree of mortgage foreclosure obtained in said Court on March 25th, 2015 in favor of BancFirst McAlester against Defendants Linda L. Pope and James C. Pope and in rem against the subject real estate, premises and personal property herein sued upon, in the sum of $54,112.46 in principal accrued as of January 29th, 2015, plus filing costs of $293.70, plus a reasonable attorney fee of $2,500.00, and other cost advanced by the attorney of $133.98, plus late charges accrued and accruing, plus advances for taxes, insurance, plus all court costs and future attorneys¹ fees incurred with collection of said indebtedness, plus post-judgment interest at the contract rate of at a variable rate of interest which is the Weekly Average Yield on U.S. Treasury Securities Adjusted to a Constant Maturity of Three Years (the ³Index²) plus 5.125 percentage points rounded to the nearest 0.125 percent, which is currently 6.125 % until paid, or the statutory rate on all amounts whichever is greater from the date of said judgment until paid; I, the Sheriff of Pittsburg County, Will on the 4th day of June, 2015, at the hour of 10:00 o¹clock a.m. at the Pittsburg County Courthouse, 115 E. Carl Albert Parkway, McAlester, Oklahoma, offer for sale and sell to the highest bidder for cash, the said property above described, or as much thereof as will satisfy said judgment with interest, costs and attorneys' fees, said sale to be subject to taxes on said property, if any; the total appraised value of said property being the sum of $39,500.00.
