Case No. CJ - 2011 - 125 NOTICE OF SALE OF LAND UNDER EXECUTION NOTICE IS HEREBY GIVEN that in pursuance of a Writ of Special Execution and Order of Sale in Foreclosure issued out of the District Court of Pontotoc County, Oklahoma on January 24, 2013 in an action wherein First United Bank and Trust Co. is Plaintiff and Brett D. Will, Amy Will and Billy Wiens, et al are Defendants, directed to me, the undersigned Sheriff of Pontotoc County, Oklahoma, commanding me to levy upon and sell with appraisement the following described real property located in Pontotoc County, Oklahoma: A part of the North 17.34 acres of Lot 3, in Section 4, Township 4 North, Range 6 East, more particularly described as follows, to-wit: Beginning at a point 475.13 feet West and 340.8 feet South of the Northeast Corner of said North 17.34 acres of Lot 3; thence South 218 feet; thence West 208 feet; thence North 218 feet; thence East 208 feet to the point of beginning, Pontotoc County Oklahoma (said property being more commonly known as 692 Catfish Kettle Road, Ada, Oklahoma); to satisfy judgments and decree of mortgage foreclosure in favor of said Plaintiff and against Brett D. Will and Billy Wiens obtained and made in said Court on January 23, 2013 on Plaintiff’s cause of action wherein the Court found there was due to Plaintiff the total principal sum of $88,364.19 inclusive of interest and late fees through December 17, 2012, plus interest accruing thereafter at the contractual rate specifically set forth in the Journal Entry of Judgment (6.50%) per annum on the unpaid balance; together with the an attorney's fee and costs incurred through date of judgment in the amount of $3,659.05; and for all costs accrued and accruing until paid, including property preservation costs to be advanced by Plaintiff. I will on the 27th day of March, 2013, at the hour of 10:00 o’clock a.m. of said day at the Courthouse in Ada, Pontotoc County, Oklahoma, offer for sale and sell to the highest bidder for cash the said property above described, or as much thereof as will satisfy said judgment with interest, costs, and attorney’s fees, said sale to be subject to taxes on said property, if any; the total appraised value of the real property being the sum of $35,000.00.
